Terms of Service
Measure App gives you estimates, not certified measurements. It is a handy everyday tool, not a calibrated instrument. Do not rely on it where an inaccurate figure could cause injury, damage, financial loss or a legal consequence. Check those with a physical tape measure, level or professional instrument.
These terms are an agreement between you and Arron Mecwan, an individual developer (“we”, “us”), covering the Measure App iOS application (the “app”) and this website, getmeasureapp.com, including its guides, comparisons and free in-browser tools (the “website”). By downloading or using the app, or using the website, you accept these terms. If you don’t accept them, please don’t use the app or the website.
1. Licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices that you own or control, in line with the App Store Terms of Service and Apple’s Licensed Application End User License Agreement. This is a licence to use the app, not a sale of it. We keep all rights not expressly granted to you here.
2. Measurements are approximate and may not be accurate
This is the most important section of these terms. Every measurement, reading, size and result produced by the app, in every one of its tools, is an approximate estimate and may not be accurate. That includes Measure, Area, Height, Angle, Floor Plan, Level, Ring Size, Stud Finder and Ruler, and any saved measurement, floor plan or exported PDF. The same applies to the free tools on the website, such as the square footage calculator, the ring size chart and printable sizer, the online ruler and the roof pitch calculator.
The app estimates physical quantities using your device’s camera, motion sensors, magnetic sensor and screen. Each of those methods has real limits:
- Augmented-reality measurements (distance, height, angles, area and floor plans) depend on your device recognising surfaces in the room. Lighting, shiny or plain untextured surfaces, distance, camera shake and how carefully you place each point all affect accuracy. Errors of several percent are normal, and larger errors are possible in poor conditions.
- The bubble level and inclinometer report the tilt of your device, which matches the surface only as well as the device sits flat against it. A case, a camera bump, dust or debris will skew the reading.
- The on-screen ruler and ring sizer depend on knowing your screen’s physical pixel density, which iOS does not report to apps. We use a table of known devices; a device we don’t recognise uses a close estimate, which may be off by a few percent.
- Ring sizes are approximate and are affected by band width and by natural changes in finger size during the day. Ask a jeweller to confirm a size before you buy.
- The Stud Finder senses iron and steel only, such as screws and nails. It cannot detect wood, pipes or electrical wires, and a reading (or no reading) does not mean it is safe to drill, nail or screw into a wall. Never drill using it alone. Check the wall another way first and, if in doubt, ask a qualified professional.
Do not use the app or the website as the only basis for any decision where an inaccurate measurement could cause harm or loss. That includes, without limitation: construction, structural, engineering, electrical or safety work; medical or diagnostic purposes; navigation; legal, survey, property, valuation or regulatory documents; and any cutting, ordering or manufacturing that can’t be undone. Always check with proper tools, such as a tape measure, a spirit level or a jeweller’s ring sizer.
You are responsible for deciding whether the app is suitable for what you are doing, and for checking any figure that matters.
3. Subscriptions and billing
Some features need a Measure App Pro subscription. All subscriptions are sold and processed by Apple through your Apple Account. We never handle your payment details.
- Payment is charged to your Apple Account when you confirm the purchase, or when a free trial ends.
- Free trials, where offered, convert to a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends. Any unused part of a free trial is forfeited if you buy a subscription during it.
- Auto-renewal. Your subscription renews automatically at the then-current price unless you turn off auto-renew at least 24 hours before the current period ends. Renewal is charged within 24 hours before the period ends.
- Cancelling is done in your Apple Account’s subscription settings, not in the app. Cancelling stops the next renewal; you keep access until the end of the period you have paid for. Deleting the app does not cancel a subscription.
- Refunds are handled by Apple under its own policies. We can’t issue refunds for App Store purchases. Requests go through reportaproblem.apple.com.
- Prices may change. Apple will tell you and, where required, ask for your consent before a new price applies to a renewal.
Current prices and terms are shown in the app before you confirm any purchase.
4. Acceptable use
Please use the app and the website lawfully and reasonably. You agree not to reverse-engineer, decompile or disassemble the app except where the law prohibits that restriction; not to copy, resell, sublicense or redistribute the app; not to get around the subscription or otherwise get paid features without paying; not to scrape, copy large parts of, try to break or overload the website; and not to use either to infringe anyone’s rights, including by photographing people or private property where you have no right to.
5. Your content
Measurements, photos, notes and floor plans you create with the app are yours. They are stored on your device and we never receive them, so we claim no rights over them and are not responsible for backing them up. Exporting or sharing anything you create is your decision.
6. Our content and intellectual property
The app, its source code, design, interface, icon and name, and the text, design, graphics and tools on the website, belong to us unless stated otherwise, and are protected by copyright and other laws. These terms don’t give you ownership of them or any right to use our name or branding.
7. Guides and comparisons on the website
Our guides explain how to measure things and restate information from official sources, which we link next to each fact. They are general information, not professional, safety, building, electrical, legal or financial advice, and they are not reviewed by a professional (see how we write our guides). Sources change, so check the original source and ask a qualified professional before acting on anything that matters.
Our comparison pages use only what each app’s App Store listing showed on the date stated on the page. Ratings, prices and features change. We make Measure App, so we are not neutral. Other apps’ names and trademarks belong to their owners; we are not affiliated with them.
8. Links to other websites
We link to other websites, such as official sources and the App Store. We don’t control them and aren’t responsible for their content or privacy practices.
9. Availability and changes
We may update, change or discontinue the app, the website or any of their features at any time. The camera tools need a device that supports ARKit.
10. No warranty
The app and the website are provided “as is” and “as available”, without warranty of any kind. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t promise that the app or website will be uninterrupted or error-free, or that any measurement will be accurate or fit for your purpose.
11. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profit, revenue, data or business, arising from your use of the app or the website, including damage to property, injury, wasted materials, or purchases made in reliance on a measurement. Our total liability to you for all claims is limited to the greater of the amount you paid us for the app in the twelve months before the claim arose, or ten US dollars.
12. Your statutory rights
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can’t lawfully be excluded. If you are a consumer, you keep the full benefit of any mandatory consumer protection rights under the law of your country, and nothing here overrides them.
13. Apple
Measure App is an independent app. It is not made by, affiliated with or endorsed by Apple, and it is not the Measure app that comes with iPhone. Apple, iPhone, iPad and App Store are trademarks of Apple Inc.
Apple is not a party to these terms and has no responsibility for the app. Apple has no obligation to provide support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price; to the maximum extent the law allows, Apple has no other warranty obligation for the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
14. Changes to these terms
We may revise these terms from time to time. The date at the top of this page shows when they last changed. Using the app or website after a change means you accept the revised terms. If you don’t accept them, stop using the app and website and cancel any subscription.
15. Governing law
These terms are governed by the laws of the State of Texas and the United States, without regard to conflict of law rules. If you use the app or website as a consumer outside the United States, this choice of law does not take away the protection of mandatory laws of your country, and you may bring proceedings in your local courts where the law gives you that right.
